Attorney Thelma Wyatt Moore is the former Georgia State Superior Court Judge that masterminded the Fulton County Family Court system and who is now retired and has started The Moore Law Firm In Atlanta. As an attorney now, she decided to take on the State of Texas Attorney General's "Dead Beat Dad" initiative to save two young girls and the dad from the abuse by a mom! "I took this case because too often the custodial parent uses the Family Court to hide their own abuse by having the court constantly going after the custodial parent with false allegations." "Our Court system is bogged down with many of these kinds of cases while moms, who in most cases are the custodial parent, are being abusive to the kids, and also surprisingly, to the dads ", said Judge (now Attorney) Moore. Two years ago Mr. Cooks was targeted by an aggressive Texas Attorney General’s office "Dead Beat Dad" program for allegedly owing over $60,000 in arrears. "But they were wrong," Mr. Cooks said. "I tried to get the Texas court to understand that the mom was lying about me not providing any child support or health coverage for our kids since our divorce in 2001. But it was difficult, because she is a paralegal and works for a very reputable law firm in Dallas" Mr. Cooks was right. Not only did Attorney Moore get the Georgia courts to agree with Mr. Cooks that he had provided all his obligations to their children, but he had over paid the child support payments. "Yes, the Texas Attorney General office was wrong on this case and it should have never gone this far", said Attorney Moore, "I am sorry to say, but these abuses of the court system occur because custodial parents are given the green light in some courts because of the politically correct approach to assume that the dads or non-custodial parents are guilty until proven innocent!" "It is important that we get this right", continues Attorney Moore. "The courts have an obligation to our children and to other parents whose legit cases are being backlogged while simultaneously driving up the cost and time of the courts!" "But who is really paying the cost here?" she declares. "Do we want our children to pay the cost?" The Texas Attorney's office is headed by Greg Abbott and who has been quoted as saying this about his "Dead Beat Dad" program; "These parents turned their backs on their children by refusing to pay child support. Please help me hold these Child Support Evaders accountable by providing information that will lead to their arrest," said Attorney General Abbott. "Parents who avoid their responsibilities to their children must be apprehended and punished." "I may have become one of his "Evaders" and in his "Top Ten Most Wanted List", if I was found guilty", says Mr. Cooks. But what the Texas court didn't know was that the mom in this case had a history of abusive behavior that was identified by the Mr. Cooks early in his Georgia court cases in the mid 1990's when this nightmare began. "Mr. Cooks case had a Guardian Ad Litem to represent their children." "And this is how abuse travels from one generation to next, when the early family psychological and physical abuse issues are not detected early by the courts and other family support organizations". "This case has cost me my career, my early family life with our girls and my retirement plans because of the financial obligations for legal representation that also included many hours in litigation through the years", said Mr. Cooks. Mr. Cooks filed for bankruptcy this September ... but he is quick to say it is not all due just to his legal obligations ..."yes times are tough now, and with the stress of keeping your family together, it all has come to this!" "I heard in Detroit that the unemployment rate for Black men today is 50%! "Can you imagine what the family court looks like there today?" "But this story is not really about me, it’s about our children!" "They suffer and they may carry this abuse to the next generation!" he said. "I have to tell you I did not have much faith in the courts and lawyers after all these years because of the many decision against me, and in my mind, against our children until I got Judge Moore to defend me" "She is Great!" "I highly recommend her!", he shouts with a smile, She knows the story." "These cases must "Be Legit!", fires Attorney Moore. "If we get these cases legit, our courts will save our kids, and you can trust me on that one!" Attorney Moore is backing up her commitment to be a positive force on these issues. She has a program, quite appropriately called, "Be Legit" which counsels individuals, parents, businesses and other legislative groups and which also supports legislation to get this right the first time. "Be Legit", and the courts will get it right," proclaims retired Judge Moore.
